Terms and Conditions

1. Scope and classification

These terms and conditions ("Terms") govern the use of the comparison platform healthcheckup.ch (the "Platform"). The operator is [ADD YOUR NAME], [STREET, NUMBER, ZIP, CITY] (the "Operator"). By using the Platform you accept these Terms.

healthcheckup.ch is an independent, free-to-use comparison portal for health check-ups in Switzerland. The Platform itself does not provide medical services and is never a party to any contract between you and a listed provider (a "Provider"). The treatment contract is formed exclusively between you and the Provider.

2. Service

The Platform compiles information about health check-ups from various Swiss Providers and makes them comparable. Depending on the check-up, the Platform offers two contact paths:

  • Direct to provider: For check-ups without an agreement between the Platform and the Provider, a button to the Provider's own website is displayed. Contact and booking happen entirely between you and the Provider; here the Platform acts exclusively as an information and link provider.
  • Inquiry via the Platform: For check-ups with an agreement, an inquiry can be submitted through the Platform's form. This inquiry is forwarded to the Provider, who contacts you directly to confirm an appointment.

The applicable path is clearly indicated on the detail page of the respective check-up.

3. No warranty on listings

All information shown on the Platform, in particular prices, service scope, duration, included examinations, target audiences, languages and locations, is supplied by the Providers or collected from publicly available sources. This information may change at any time without prior notice on the Platform.

The Operator gives no warranty as to the accuracy, completeness, timeliness or availability of the information or offers displayed. The only binding information is what the Provider confirms to you in the specific case. Please verify prices and conditions directly with the Provider before entering into any agreement.

4. Formation of the contract

In both paths above, a contract between you and the Provider is formed only once the Provider confirms it. Using the Platform, clicking through to a Provider's website, or submitting an inquiry do not by themselves create a treatment or purchase contract.

5. Prices, rebates and commissions

  • Prices shown on the Platform come from the Providers and are in Swiss francs (CHF), including any VAT unless stated otherwise.
  • The Platform currently offers no rebates by default. Rebates are negotiated individually with Providers, and where they exist, they are clearly marked as such ("Exclusive rebate"). Without such marking, the Provider's regularly communicated price applies.
  • Invoicing is done directly by the Provider after the service is rendered, or in line with the Provider's own payment terms. The Platform is not involved in billing.
  • The Operator may receive a referral commission from individual Providers. Such commissions are settled exclusively between the Operator and the Provider and never add a markup for you.

6. Cancellation and rescheduling

Cancellations, reschedulings and no-shows are governed exclusively by the terms of the respective Provider. Please contact the Provider directly as soon as you know you cannot keep the appointment.

The specific distance-selling protection found in EU law does not exist in Swiss contract law. There is no statutory right of withdrawal.

7. User obligations

You undertake to provide truthful and complete information when submitting an inquiry. The Platform may reject, block or forward inquiries if there is a reasonable suspicion of misuse (e.g. obviously false information, automated mass requests).

8. Reviews

  • Reviews can only be submitted after the service has been rendered.
  • Reviews are moderated before publication to filter out offensive, defamatory, promotional or unlawful content.
  • By submitting a review, you grant the Platform the right to display the content publicly alongside your first name (no last name).
  • Fake reviews are prohibited and will be removed.

9. Limitation of liability

The Platform is provided as a free-to-use information and comparison service. To the extent permitted by law, the Operator disclaims all liability, in particular, but not exclusively, for:

  • the accuracy, completeness, timeliness or availability of the offers, prices, services and any other information displayed on the Platform;
  • the medical quality, care, suitability or availability of services provided by Providers;
  • appointment confirmations, reschedulings, cancellations or other conduct of Providers;
  • content, data protection practice and availability of third-party websites linked from the Platform;
  • interruptions, errors or unavailability of the Platform (maintenance, force majeure, attacks, failures of third parties).

The Operator is only liable for intent and gross negligence within the limits of mandatory Swiss law (Art. 100 CO). Indirect damages, lost profits and consequential damages are excluded to the extent permitted by law.

10. Intellectual property

All content, designs, texts, logos and software components of the Platform are protected by copyright. Any use beyond these Terms requires prior written consent.

11. Data protection

The processing of personal data is governed by the privacy policy published on the Platform. By using the Platform you agree to that processing.

12. Changes to the Terms

The Operator may amend these Terms at any time. The version published on the Platform is always the current one. Material changes will be communicated in an appropriate form.

13. Final provisions

If individual provisions of these Terms are invalid, the remaining provisions remain in effect. The invalid provision will be replaced by a regulation that comes as close as possible to the economic purpose of the invalid provision.

14. Governing law and jurisdiction

These Terms are governed exclusively by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and the conflict-of-laws provisions of the Swiss Federal Act on Private International Law. Exclusive place of jurisdiction is Zurich, Switzerland, to the extent mandatory statutory provisions do not require a different venue.
